Jury awards $18.5 million to hunter who sued treestand manufacturer for injuries

A Jefferson Circuit Court jury returned an $18.5 million verdict Thursday night against a treestand manufacturer it found had failed to reasonably warn about the risks of the product.

The verdict against Primal Vantage Co. was awarded to Kevin O’Bryan, who was found 50 percent at fault for his injuries, meaning the damages awarded to him will be reduced by that amount.

According to the verdict form, the jury award included $869,975 for past medical expenses, $1.2 million for lost wages and $13 million for pain and suffering, as well as $80,000 to Sante O'Bryan, now his ex-wife, for loss of consortium.

The jury unanimously found that the company manufactured an unreasonably dangerous product without warning of the risks involved with using polypropylene straps to secure the treestand and that its failure to issue that warning caused O’Bryan’s injuries on May 3, 2012.

The company, based in Bernardsville, New Jersey, was defended by Detroit attorneys Milton Karfis and Bishop Bartoni and Louisville lawyer Casey Wood Hensley.O'Bryan was turkey hunting on another man's land when the stand fell to the ground.O'Bryan has suffered from paralysis and excruciating pain since the accident, evidence showed.The property owner, who had strapped the stand to the tree five years earlier, was immune from liability.
